The Court finds it both surprising and troubling that plaintiff has not opposed this Motion for Summary Judgment. Since the moving party is the only remaining defendant, the effect of granting this Motion for Summary Judgment is to terminate the case. If plaintiff believed he had a meritorious case, he should have opposed this Motion for Summary Judgment. Conversely, if plaintiff believed that his case lacked merit, he should have dismissed this case prior to today’s ruling; doing so would have saved the Court and its staff hours of work in analyzing this motion.
