MOTION TO STRIKE 1ST AMENDED COMPLAINT

Matter on Calendar for Friday, October 5, 2012, Line 11, DEFENDANT NOLAN LEE'S MOTION TO STRIKE 1ST AMENDED COMPLAINT.

Granted without leave to amend as to the willful failure to warn allegations per Civil Code 846 and denied as to the punitive damages allegations. Plaintiff sufficiently alleges that defendant acted with a conscious disregard for the safety of others.
