Tentative Ruling:
This is an assault and battery case. On May 21, 2021, Plaintiff Terrance Jackson (“Plaintiffs”) was
a guest at Defendant San Jacinto Inn (“Inn”). Plaintiff alleges that while he was outside his room
preparing to go running, a security guard employed by the Inn approached him in a loud and
threatening manner. Plaintiff alleges that the security guard physically attacked him causing
serious injuries.
On October 6, 2023, Plaintiff filed his Complaint against the Inn and principle, Kalpesh Solanki
(collectively “Defendants”). He asserts five causes of action for: (1) Assault; (2) Battery; (3)
Intentional Infliction of Emotional Distress; (4) Negligence; and (5) Negligent Hiring, Supervision
and Retention.
Defendants now move for terminating sanctions against Plaintiff. Defendants assert that on July
