Motion by Defendant for Terminating Sanctions for Plaintiff’s Failure to Comply with
Court Order Compelling Discovery
TENTATIVE RULING
With no indication that Plaintiff complied with the court’s August 4, 2023 discovery order
served by mail on her on January 3, 2024, the court finds sufficient cause to grant this
unopposed motion for terminating sanctions. Plaintiff’s complaint will be stricken, and
this case dismissed. Defendant is to prepare and provide to Plaintiff for her opportunity
to approve as to form both an order on this motion and a judgment for dismissal, before
providing those to the court to sign and enter, with Defendant to thereafter serve notice
of entry of the signed documents on Plaintiff.
The court further imposes additional monetary sanctions against Plaintiff ANISSA
BIRCH, in the amount of $393.16. These additional monetary sanctions shall be due
and payable within 15 days of service of the court’s signed order.
