Tentative Ruling:
The
present
motion
is
a summary
judgment
or, alternatively,
summary
adjudication
motion
brought on the complaint by defendants Menifee PPF and Kalil (collectively, “defendants”).


Under
Code
of
Civil
Procedure
section
437c(c),
a summary
judgment
is granted
if there
is no
triable issue of material fact.
The moving party is then entitled to judgment as a matter of law.
After the moving party has met its initial burden, the court’s sole function on a summary judgment
motion is to determine whether or not there are material facts in dispute.
