Plaintiff’s Motion for Approval of Settlement.
Plaintiff moves pursuant to Code of Civil Procedure, § 664.6 and Probate Code, § 17200 for the court to confirm the parties’ settlement agreement.
The parties have come to an agreement related to decedent Potter’s personal residence, which will be sold and the proceeds distributed according to the settlement agreement. The parties have agreed that plaintiff shall seek court approval of the agreement and the parties consent to entry of an order approving and confirming the terms of the agreement with the court retaining jurisdiction under Section 664.6 to enforce the agreement. (Exhibit A- Settlement Agreement, paragraphs 2.1 and 21.)
The proof of service declares that notice of the hearing and the moving papers were served by mail to defense counsel on May 23, 2019.
