Hearing Re: Default Judgment.
On June 30, 2020, plaintiffs filed a complaint against various defendants to quiet title, for declaratory relief and for preliminary and permanent injunctions allegedly arising from an alleged failure by defendant GMAC to release and reconvey all of defendants’ interests in the plaintiffs’ real property after the plaintiffs repaid the loan secured by the Deed of Trust in September 2003 as part of a refinance transaction and defendants’ clerical and scrivener’s errors in referencing the incorrect loan and deed of trust numbers from the 1993 Deed of Trust. On August 31, 2020 the amended complaint was filed against various defendants asserting causes of action to quiet title, for declaratory relief, for preliminary and permanent injunctions, and to cancel the recorded 1995 assignment of the deed of trust from defendant GMAC to defendant LaSalle National Bank.
On October 21, 2020 default was entered against defendants GMAC Mortgage Corp., and Bank of America.
