Hearing Re: Default Judgment.
On September 30, 2020 plaintiff County filed a complaint against defendant asserting causes of action for preliminary and permanent injunction for interference with easement, private nuisance, and damages. The County moved for issuance of a preliminary injunction against defendant. After the contested hearing on the OSC Re: Preliminary Injunction the court issued a preliminary injunction on October 16, 2020. The proof of service filed on October 5, 2020 declares that defendant was personally served the summons, complaint and other litigation documents on October 1, 2020. The clerk initially entered defendant’s default on November 13, 2020 and in response to an amended request for entry of default, the clerk entered default on November 20, 2020
After default the plaintiff may apply to the court for the relief demanded in the complaint; the court shall hear the evidence offered by the plaintiff, and shall render judgment in his or her favor for such sum not
