The Court grants the motion in part. Plaintiff is ordered to file an Acknowledgement of Partial Satisfaction of Judgment for the second bank levy amount of $7,109.03. Otherwise, the motion is denied. FACTUAL / PROCEDURAL CONTEXT This is a breach of contract action. Plaintiff, TBF Financial I, LLC, alleges Defendant, Hemet San Jacinto Valley Chamber of Commerce, entered into a written lease agreement on 4/27/11, with Konica Minolta Premier Finance (Konica) to lease commercial equipment. The agreement required Defendant to make 60 monthly payments of $913.92. Plaintiff alleges Defendant defaulted on the agreement and owes the principal sum of $25,487.75, plus interest from the date of breach on 12/28/15. The Complaint was filed on 4/25/17 and alleges four causes of action: 1) breach of contract; 2) open book account; 3) account stated; 4) goods sold and delivered.
