Plaintiff filed an action against defendant asserting various causes of action arising from the agreement for defendant to provide design services and purchase personal property and fixtures to be acquired by defendant for plaintiff. The 1st amended complaint alleges the personal property and fixtures were not provided to plaintiff despite plaintiff having paid $29,579.42 that was invoiced by defendant; plaintiff paid defendant $1,000 for design services, which defendant failed to do as promised; plaintiff entrusted personal property to defendant that was valued at $2,463.73, which defendant has failed to return to plaintiff; and plaintiff was 65 years of age or older at the time of the aforementioned conduct The 1st amended complaint alleges plaintiff was damaged in the amount of $33,043.15 and requests treble damages pursuant to Civil Code,§§ 1780 and 3345 in the amount of $99,129.45.
