Petitioner Health NetLife Insurance Company moves the court to compel arbitration in its dispute with Respondents Zoe and Rick Del Prete. Having read and considered the written petition, opposition, and reply, the court issues the following tentative ruling:
On September 5, 2015, Respondents Zoe Del Prete and Richard Del Prete (collectively, “Respondents”) were injured in an automobile crash in San Joaquin County, California (Decl. Thompson, ¶¶ 2, 12.) The negligent third-party driver (David Moran) was uninsured. (Decl. Thompson, ¶ 3.) At the time of that crash, State Farm Mutual Automobile Insurance Company (“State Farm”) insured Respondents under a private automobile policy that included uninsured motorist (UM) coverage. (Decl. Thompson, ¶ 4.) On October 22, 2015, Respondents, through their counsel, submitted a UM claim to State Farm. (Decl. Thompson, ¶ 5, Exh. 1.)
