Defendant RWG Enterprises Inc. moves for Summary Judgment or, in the alternative, Summary Adjudication against all claims brought against them by Plaintiffs, Manuela Lopez, and her adult children, Patricia Chairez; Nick Lopez; and Katherine Lopez. Having read and considered the motion, the court issues the following tentative ruling:
Plaintiffs have filed a non-opposition.
The Complaint alleges the following causes of action against Defendant RWG: 1st cause of action – Negligence (v. all defendants); 2nd cause of action – Wrongful Death (v. all defendants); 3rd cause of action – Negligent Infliction of Emotional Distress (v. all defendants).
This lawsuit was filed after a tragic accident involving two freightliners in San Joaquin County. One of the drivers, Willie Lopez, was killed as a result of the accident.
