A writ for sequestration is a remedy for the preservation and protection of a security interest in personal property. (Radcliff Fin. Corp. v. The Indus. State Bank of Houston, 289 S.W.2d 645, 649 [Tex. App. 1956].)
In order to show itself entitled to a writ of sequestration, a plaintiff must
(Tex. Civ. P. Prac. & Rem. Code, § 62.001(1), (2); Tex. Civ. P. Prac. & Rem. Code, § 62.022; Marrs v. South Texas National Bank, 686 S.W.2d 675, 677-78 [Tex. App. 1985].)
Specifically, an application for a writ of sequestration must set forth
(Tex. Civ. P. Prac. & Rem. Code, § 62.022(1)-(3).)
An application for writ of sequestration and any affidavits shall be made on personal knowledge and shall set forth such facts as would be admissible in evidence; facts may be stated based upon information and belief if the grounds of such belief are specifically stated.(Tex. R. Civ. P. 696.) The burden is on the party seeking the writ to prove both the facts alleged and the grounds relied upon for its issuance. (Rexford v. Holliday, 807 S.W.2d 356, 358 [Tex. App. 1991].)
Using property in an ordinary manner does not constitute injury sufficient for sequestration, even if it leads to depreciation. (Commercial Acceptance Trust v. Parmer, 241 S.W. 586, 589 [Tex. App. 1922].) An unsubstantiated fear that the defendant will injure the property is insufficient, particularly when the defendant provided uncontroverted evidence that (s)he has no such intent. (Dallas Joint Stock Land Bank v. Lancaster, 91 S.W.2d 890, 891-92 [Tex. App. 1936].)
Moreover, sequestration is not available when the plaintiff seeks damages and not recovery of the property at issue. (White v. Texas Motorcar & Supply Co., 203 S.W.441, 443 [Tex. App. 1918]; Houston v. Booth, 107 S.W. 887, 888 [Tex. App. 1908].)
Sequestration proceedings are summary in their nature. (American Mortg. Corp. v. Samuell, 108 S.W.2d 193 [Tex. 1937].) A party applying for a writ of sequestration must strictly comply with the requirements of Section 62 of Texas Civil Practice and Remedies Code and the Texas Rules of Civil Procedure. (Id.)
A court may only allow a writ of sequestration by making specific findings of fact to support the sequestration. (Tex. R. Civ. P. 696.) The court must find that the personal property is in an immediate danger of being wasted and must enter specific factual findings supporting that ruling. (Id.)
The application for sequestration must state the specific facts that warrant a finding that a party will injure or remove the personal property. (Callaway v. East Texas Governmental Credit Union, 619 S.W.2d 411, 414 [Tex. App. 1981].) If no such facts are provided, then as a matter of law, the application must be denied. (Id. at 415.)
