What Is a Motion to Extend Discovery?

Background

“The trial court is authorized to control and limit discovery.” (See Board, Healing Arts v. Spinden (1990) 798 S.W.2d 472, 478.)

“The court for cause shown may at any time in its discretion extend the length of such a time period with or without motion if a request is made before the specified response period has expired, and upon notice and motion made after the expiration of the specified period . . . where the failure to act was the result of excusable neglect[.]" (See Inman v. St. Paul Fire Marine Ins. Co. (2011) 347 S.W.3d 569, 576.)

General Information for Complaints and Motions

“The statutes relating to discovery provide that interrogatories shall be fully answered within 15 days after service unless the court, on motion and notice and for good cause shown enlarges or shortens the time.” (See Central & Southern Truck Lines, Inc. v. Westfall GMC Truck, Inc. (1958) 317 S.W.2d 841, 847.)

Standard of Review and Burdens of Proof

“The trial court has discretion to grant a time extension for good cause.” (See Mello v. Giliberto (2002) 73 S.W.3d 669, 680.)

“Rule 74.04 provides the procedure for allowing additional time for discovery after the filing of summary judgment.” (See Southwestern Bell Yellow Pgs. v. Wilkins (1996) 920 S.W.2d 544, 551.)

“That rule gives the trial court discretion [f]or good cause shown to continue the motion for a reasonable time until the requested discovery is complete.” (See Southwestern Bell Yellow Pgs. v. Wilkins (1996) 920 S.W.2d 544, 551.)

“The propriety of discovery is within the trial court's discretion and will not be disturbed except for abuse of discretion.” (See Board, Healing Arts v. Spinden (1990) 798 S.W.2d 472, 478.)

The Court’s Decisions

It is well settled that “upon motion by a party or by the person from whom discovery is sought, and for good cause shown, the court may make any order which justice requires to protect a party or person from annoyance, embarrassment, oppression, or undue burden or expense.” (See Brown v. McIbs, Inc. (1986) 722 S.W.2d 337, 342.)

However, it is also well settled that “the rule contemplates that ‘good cause’ must be shown before the trial court may enter a protective order.” (See Brown v. McIbs, Inc. (1986) 722 S.W.2d 337, 342-43.)
