“A statutory stay of execution fills the place of the writ of supersedeas under an older system of practice, though it is of much broader scope because of the administration of law and equity in Missouri in the same court.” (See The Daniel Henry Co. v. Metal Rubber Co. (1938) 234 Mo. App. 792, 796.)
“The stay is subject to the order of the court in which the cause is pending, in accordance with the demands of justice and the obvious spirit of the statutes authorizing a stay.” (See id.)
“The order of court which produces a stay of execution is like other orders or process of the court; namely, subject to the control of the court, so that it shall not become an instrument of injustice.” (See id.)
“The granting or refusing of a stay of proceedings rests in the trial court's discretion, the exercise of which will not be disturbed on appeal unless clearly abused.” (See U.S. Bank, N.A. v. Douglas L. Coverdell, & Coverdell Enters., Inc. (2015) 483 S.W.3d 390, 401.)
“Stay of proceedings is not a matter of right but involves the exercise of some discretion by the trial court as to granting and as to duration; but it would be an abuse of discretion to refuse a stay properly required by the circumstances.” (See U.S. Bank, N.A. v. Douglas L. Coverdell, & Coverdell Enters., Inc. (2015) 483 S.W.3d 390, 401.)
“Stay of proceedings is not a matter of right but involves the exercise of some discretion by the trial court as to granting and as to duration; but it would be an abuse of discretion to refuse a stay properly required by the circumstances.” (See id.)
It is well settled that “a trial court has the power to grant a stay of proceedings on the ground that another action is pending, but whether it should be granted in a certain case is discretionary with that court.” (See In Interest of S.M (1988) 750 S.W.2d 650, 655 (Mo. Ct. App. 1988)
It is also well settled that “where no statute mandates a stay, a motion to stay the proceedings pending arbitration is a matter for the discretion of the trial court.” (See Shelter Prods., Inc. v. Omni Constr. Co. (2016) 479 S.W.3d 189, 198.)
