Tentative Ruling:
To grant plaintiff’s motion for default judgment, and the request for attorney’s fees and costs.
If oral argument is requested, the hearing will be held on February 8th, 2018 at 3:30 p.m. in Department 503.
Explanation:
The City has attempted to obtain defendant’s compliance in correcting the unsafe and unsanitary conditions on the subject property for the last 13 years, and defendant has been unable or unwilling to comply. The City previously obtained a stipulated judgment against defendant in 2010, but defendant immediately failed to take any corrective action after the judgment was entered. There continue to be multiple violations of the Fresno Municipal Code on the property, and it poses a risk to public health and safety. In fact, the property has already caught fire once, and it has been used by squatters in the past despite the lack of water, heat, or power. Defendant’s default has now….....
