“Any objections to impertinent or scandalous matters in a pleading are properly raised by a party in a motion to strike.” (See Doe v. Doe (1996) 324 S.C. 492, 499, 478 S.E.2d 854, 857; Hackworth v. Greywood at Hammett (2009) 385 S.C. 110, 114.)
Rule 12(f) of the South Carolina Rules of Civil Procedure governs motions to strike.
“Upon motion pointing out the defects complained of, and made by a party before responding to a pleading or, if no responsive pleading is required within 30 days after the service of the pleading upon him or upon the court's own initiative, at any time the court may order stricken from any pleading any insufficient defense or any redundant, immaterial, impertinent or scandalous matter.” (See S.C. R. Civ. P. 12(f).)
“A motion to strike language from a pleading, as irrelevant or immaterial, is generally within the discretion of the judge.” (See Sams v. Sams (1966) 247 S.C. 467, 469.)
“Thus, the grant of a motion to strike will not be reversed except for an abuse of discretion or error of law.” (See Robinson v. Code (2009) 384 S.C. 582, 585.)

“A motion to strike that challenges a theory of recovery in the pleading is in the nature of a motion to dismiss under Rule 12(b)(6), SCRCP.” (See Hackworth v. Greywood at Hammett (2009) 385 S.C. 110, 114-15; McCormick v. England (1997) 328 S.C. 627, 632, 494 S.E.2d 431, 433.)
“A ruling on a motion to dismiss a claim must be based solely on the allegations set forth on the face of the claim.” (See id.)
“The motion cannot be sustained if the acts alleged and the inferences reasonably deductible therefrom would entitle the plaintiff to any relief on any theory of the case.” (See id.)
It is well settled that “a motion to strike, challenging a theory of recovery in the complaint, is comparable to a motion to dismiss under Rule 12(b)(6), SCRCP. Where a pleading is attacked for an alleged failure to state a cause of action, the pleading must be liberally construed in favor of the pleader and sustained if the facts and reasonable inferences to be drawn therefrom entitle the pleader to relief on any theory of the case. A court should not strike a cause of action merely because the court doubts the plaintiff will prevail in the action.” (See Robinson v. Code (2009) 384 S.C. 582, 585; McCormick v. England (1997) 328 S.C. 627, 632, 494 S.E.2d 431, 433; Burns v. Wannamaker (1985) 286 S.C. 336, 339, 333 S.E.2d 358, 360.)
It is also well settled that “Rule 14(a) of the South Carolina Rules of Civil Procedure, like its federal counterpart, FED. R. CIV. P. 14(a), allows any party, including a third-party defendant, to move to strike the third-party claim, or [move] for its severance or separate trial. The question of whether to grant a motion to strike a third-party claim, whether filed with or without the leave of court, is addressed to the sound discretion of the trial court.” (See Beach v. Smith (1989) 298 S.C. 424, 426; Swenson v. Suhl (1956) 19 F.R.D. 517, 519.)
