“A seller of a product in a defective condition unreasonably dangerous to the user is subject to liability for injuries caused to the user by the product if the seller is engaged in the business of selling such a product and it reaches the user without substantial change in the condition in which it was sold.” (See Parks v. Steak Ale, No. 01-04-00080-CV, at *1 (Tex. App. Jan. 12, 2006).)
“To recover under a theory of strict liability, a plaintiff must prove the defective and unreasonably dangerous condition of the defendant's product and a causal connection between the condition and the plaintiff's injuries or damages.” (See Hyundai Motor Co. v. Chandler (1994) 882 S.W.2d 606, 610.)
“A plaintiff may prove a product defective if it is unreasonably dangerous in construction, or if it is unreasonably dangerous as designed, or if it is unreasonably dangerous because adequate warnings or instructions were not provided.” (See id.)
“We review a summary judgment de novo.” (See Harkins v. Wal-Mart Stores Tex., LLC, No. 02-21-00201-CV, at *9 (Tex. App. June 23, 2022).)
“The movant for summary judgment has the burden of showing there is no genuine issue of material fact and it is entitled to judgment as a matter of law.” (See Nixon v. Mr. Property Management Co. (1985) 690 S.W.2d 546, 548; Powell v. Foxall (2001) 65 S.W.3d 756, 758.)
“In deciding whether a disputed material fact issue precludes summary judgment, evidence favorable to the non-movant is taken as true.” (See id.)
“Every reasonable inference in favor of the non-movant is indulged and any doubts are resolved in its favor.” (See id.)
“The movant must either disprove at least one element of each of plaintiff's theories of recovery or conclusively establish each essential element of an affirmative defense.” (See City of Houston v. Clear Creek Basin Auth. (1979) 589 S.W.2d 671, 678; Powell v. Foxall (2001) 65 S.W.3d 756, 758.)
“If the movant conclusively proves all essential elements of his defense, the burden shifts to the non-movant.” (See Powell v. Foxall (2001) 65 S.W.3d 756, 758.)
“The non-movant must answer that affirmative defense for summary judgment purposes.” (See id.)
It is well settled that “damages allegedly caused by a defective product are those sought from a product unreasonably dangerous because of a defect in marketing, design, or manufacturing.” (See PS Invs., L.P. v. S. Instrument & Valve Co. (2014) 438 S.W.3d 638, 641.)
It is also well settled that “a defectively designed product is one that is unreasonably dangerous . . . taking into consideration the utility of the product and the risk involved in its use.” (See Jaimes v. Fiesta Mart (1999) 21 S.W.3d 301, 306.)
