A motion to reconsider is appropriate in the following circumstances:
(Fisherman’s Harvest, Inc. v. Post, Buckley, Schuh & Jernigan, Inc., et al. (2008) No. G-05-0151, 2008 WL 4277001, at *2.)
Tex. R. Civ. P. 329b governs the timing for a motion for reconsideration. Such a motion:
(Id., at subsections (a) and (g).)
Further, an appeal on a motion for reconsideration “if a judgment is modified, corrected or reformed in any respect, the time for appeal shall run from the time the modified, corrected, or reformed judgment is signed...” (Tex. R. Civ. P. 329b subsection (h).)
“When a motion [to reconsider] is filed after the rendition of summary judgment, ‘a trial court has the discretion to consider the grounds in [the] post-judgment motion and supporting proof[,] and reaffirm its summary judgment based on the entire record.’” (PNP Petroleum I, LP v. Taylor (2014) 438 S.W.3d 723, 729 quoting Charbonnet v. Shami, No. 04–12–00711–CV, 2013 WL 2645720, at *5 (mem. op.) [quoting Timothy Patton, Summary Judgments in Texas § 7.06 [1] (3d ed. 2012.])
“The trial court also has the discretion to simply deny a motion filed after the entry of summary judgment without considering its substance.” (Id.) “In the latter situation, an appellate court need only consider arguments and evidence presented prior to the summary-judgment hearing.” (Id.) “Thus, the efficacy of a post-judgment motion to preserve a complaint for appellate review depends upon whether the trial court affirmatively considers the new grounds and proof as memorialized by a written order.'” (Id., quoting Timothy Patton, Summary Judgments in Texas § 7.06[1] [3d ed. 2012.])
“Where the trial court affirmatively indicates on the record that it accepted or considered the evidence attached to a motion to reconsider, this court reviews “the summary judgment based upon the grounds and proof in both prejudgment and post-judgment filings.” (PNP Petroleum I, LP v. Taylor (2014) 438 S.W.3d 723, 730 citing Timothy Patton, Summary Judgments in Texas § 7.06[1] supra; see also Circle X Land & Cattle Co., Ltd. v. Mumford Ind. Sch. Dist. (2010) 325 S.W.3d 859, 863 (Tex.App.-Houston [14th Dist.] 2010, pet. denied) [holding appellate court would review evidence attached to motion to reconsider where order reflected that the affidavits and exhibits were considered by the trial court]; Stephens v. Dolcefino (2003) 126 S.W.3d 120, 134 [same, where trial court verbally ruled that it would include the evidence offered at the hearing on the motion to reconsider in the summary judgment record]; but see, McMahan v. Greenwood (2003) 108 S.W.3d 467, 500 [holding appellate court would not consider evidence attached to motion for new trial where order denying the motion stated that trial court considered the motion, responses, and argument of counsel but did not state that it considered the evidence attached to the motion.])
A party may file a motion for en banc reconsideration as a separate motion, with or without filing a motion for rehearing. (Tex. R. App. P. 49.7.) The motion must be filed within 15 days after the court of appeals' judgment or order, or when permitted, within 15 days after the court of appeals' denial of the party's last timely filed motion for rehearing or en banc reconsideration. While the court has plenary power, a majority of the en banc court may, with or without a motion, order en banc reconsideration of a panel's decision. (Id.) If a majority orders reconsideration, the panel's judgment or order does not become final, and the case will be resubmitted to the court for en banc review and disposition. (Id.)
“Under both the FAA and the TAA, the denial of a motion to compel arbitration is immediately appealable, but the denial of a motion to reconsider the denial of a motion to compel arbitration is not immediately appealable.” (Brand FX, LLC v. Rhine (2015) 458 S.W.3d 195, 201 citing 9 U.S.C.A. § 16 [West 2009]; Tex. Civ. Prac. & Rem. Code Ann. § 51.016 [West 2015], § 171.098 (West 2011) ; Nazareth Hall Nursing Ctr. v. Castro (2012) 374 S.W.3d 590, 593–94; AXA Fin., Inc. v. Roberts, No. 03–07–00079–CV, 2007 WL 2403210, at *3.)
Indeed, where an “[a]ppellants' motion to reconsider request[s] the same relief based on the same Arbitration Agreement as in [a] motion to compel, and it raise[s] no new distinct arguments for compelling arbitration, [the court has no] jurisdiction to consider Appellants' challenge to the order denying Appellants' motion to reconsider raised....” (SK Plymouth, LLC v. Simmons (2020) No. 01-19-00433-CV, at *12-13 citing Brand FX, LLC, supra, 458 S.W.3d at 201; Nazareth Hall Nursing Ctr. v. Castro (2012) 374 S.W.3d 590 at 594.)
In certain circumstances, “[a] motion for reconsideration operate[s] to extend the appellate timetable in [a] severed cause.” (Padilla v. Lafrance (1995) 907 S.W.2d 454, 459 citing McRoberts v. Ryals (1993) 863 S.W.2d 450, 454-55; see also Mueller v. Saravia (1992) 826 S.W.2d 608, 609.)
A trial court's decision on a motion to reconsider [is reviewed] under an abuse of discretion standard. (Owen v. State (2011) 352 S.W.3d 542, 545.) “A trial court abuses its discretion when it acts arbitrarily or unreasonably, without reference to guiding rules or principles.” (Iliff v. Iliff (2011) 339 S.W.3d 74, 78.)
