“Rule 197.1 permits a party to serve contention interrogatories to ‘inquire whether a party makes a specific legal or factual contention and may ask the responding party to state the legal theories and to describe in general the factual bases for the party's claims or defenses...’” (In re Sting Soccer Grp. (2017) LP No. 05-17-00317-CV, at *9 citing Tex. R. Civ. P. 197.1; see TEX .R. CIV. P. 192.3(j) ("A party may obtain discovery of any other party's legal contentions and the factual bases for those contentions."). The party may not use interrogatories to require the responding party to marshal all of its available proof or the proof the party intends to offer at trial. (TEX. R. CIV. P. 197.1.) Marshaling means “[a]rranging all of a party's evidence in the order that it will be presented at trial.” (Sheffield Dev. Co., Inc. v. Carter & Burgess, Inc. 2012 No. 02-11-00204-CV, 2012 WL 6632500, at *6 (quoting Black's Law Dictionary 1063 (9th ed. 2009)).
“[R]equests for production may properly ask a party to provide ‘all,’ ‘each,’ or ‘every’ document pertaining to a relevant, narrow subject of the litigation.” (In re Allstate (2007) 227 S.W.3d 667, 669; Robert K. Wise, Ending Evasive Responses to Written Discovery: A Guide for Properly Responding (and Objecting) to Interrogatories and Document Requests Under the Texas Discovery Rules, 65 BAYLOR L. REV. 510, 598 (2013).) ‘Marshalling the evidence’ is not considered a valid objection to a request for production because, unlike the rule of civil procedure regarding interrogatories and requests for disclosure, the rules regarding requests for production does not include any language concerning the marshalling of evidence. 65 BAYLOR L. REV. at 598.” (In re Sting Soccer Grp., LP (2017) No. 05-17-00317-CV, at *12.)
“The primary purpose of requests for admission is to simplify trials by eliminating matters about which there is no real controversy; to obviate in advance of trial, proof of obviously undisputed facts.” (In re Sting Soccer Grp., LP (2017) No. 05-17-00317-CV, at *13 citing Mosby v. Tex. & P. Ry. Co. (1945) 191 S.W.2d 55, 58; see generally Tex. R. Civ. P. 198.1-198.3.) Rule 198.2(c) requires a party to specifically admit or deny a request for admission. (TEX. R. CIV. P. 198.2(c).) If the party cannot admit or deny the request, then the party must explain in detail the reasons that the party cannot admit or deny the request. (Id.) A response must fairly meet the substance of the request. (Id.) The responding party may qualify an answer, or deny a request in part, only when good faith requires. (Id.)
When moving the court to compel further responses to discovery under Tex. R. Civ. P. 215.1(a),(b),(c) the motion should include the following:
(See Able Supply Co. v. Moye (1995) 898 S.W.2d 766, 771, stating “Rules 166b(6)(c) and 215(1)(b) and (c), ... provide parties with a procedural mechanism for compelling an answer to an interrogatory. Rule 166b(6)(c) provides that a duty to supplement discovery answers may be imposed "by order of the court." (Tex.R.Civ.P. 166b(6)(c).) Rule 215(1)(b)(3)(b) provides that a party may move for an order compelling an answer when a party fails to answer an interrogatory. (Tex.R.Civ.P. 215(1)(b)(3)(b).) Rule 215(1)(c) states that for purposes of Rule 215, an evasive or incomplete answer is to be treated as a failure to answer. (Tex.R.Civ.P. 215(1)(c).)
While courts generally do not review orders refusing to compel discovery, mandamus relief may be granted when the denial of discovery goes to the heart of a party's case or vitiates or severely compromises a party's ability to present a viable claim or defense. (In re Allied Chem. Corp.(2007) 227 S.W.3d 652, 658; Able Supply Co. v. Moye (Tex. 1995) 898 S.W.2d 766, 772.)
“The discovery rules have been amended since Able Supply, now requiring that ‘a party must make a complete response, based on all information reasonably available to the responding party or its attorney at the time the response is made.’ Parties and attorneys certify this to be true when they sign a discovery response; they can no longer simply choose to delay disclosure until the last minute.” (In re Allied Chemical Corp. (2007) 227 S.W.3d 652, 657 citing Tex.R. Civ. P. 193.1; see also Alex Wilson Albright, New Discovery Rules: The Supreme Court Advisory Committee's Proposal, 15 Rev. of Litig. 275, 292-93 (1996).) ("The proposed rules, therefore, require parties to respond, amend, and supplement discovery earlier than required under the current rules while parties now may wait until as few as thirty days before trial to disclose important requested discovery. Proposed Rule [193.1] requires a party to make full disclosure upon the initial response to written discovery.").
“In Jampole v. Touchy (1984) 673 S.W.2d 569, the Court... used the extraordinary writ of mandamus to compel discovery which had been denied by the trial court. ...[T]he Court in Jampole addressed whether relator had an adequate appellate remedy. The underlying suit in Jampole was a products liability action, and the disputed discovery materials included alternate design and assembly documents. The Court held that relator did not have an adequate remedy by appeal because denial of this discovery effectively prevented relator from proving the material allegations of his lawsuit. 673 S.W.2d at 576. Remedy by appeal in a discovery mandamus is not adequate where a party is required "to try his lawsuit, debilitated by the denial of proper discovery, only to have that lawsuit rendered a certain nullity on appeal....” (Id.)
