“A judgment that has been vacated has no legal effect.” (Pringle v. Moon (2005) 158 S.W.3d 607, 610-11 citing Shelby Operating Co. v. City of Waskom (1997) 964 S.W.2d 75, 80.) When a judgment has been rendered and later set aside or vacated, the matter stands precisely as if there had been no judgment. (Ferguson v. Naylor (1993) 860 S.W.2d 123, 127; Sawyer v. Donley County Hosp. Dist. (1974) 513 S.W.2d 106, 109.)
A trial court retains jurisdiction over a case for a minimum of thirty days after signing a final judgment. (Tex.R. Civ. P. 329b(d); Lane Bank Equip. Co. v. Smith Southern Equip., Inc. (2000) 10 S.W.3d 308, 310.) A trial court's plenary power may be extended by timely filing an appropriate post-judgment motion within the initial thirty-day period, such as a motion for new trial or a motion to modify, correct, or reform the judgment. (Tex.R. Civ. P. 329b(a), (e), (g); Lane Bank Equip. Co., 10 S.W.3d at 310; In re T.G. (2002) 68 S.W.3d 171, 176.) When an appropriate post-judgment motion is filed within the initial thirty-day period, the trial court's plenary power over the judgment is extended up to an additional seventy-five days, depending on when or whether the court acts on the motion. (Lane Bank Equip. Co., 10 S.W.3d at 310.) However, if no party to a judgment files a motion that extends the trial court's plenary power, the trial court loses jurisdiction over the judgment thirty days after the judgment is signed and has no power to set aside a judgment except by bill of review for sufficient cause. (Shackelford v. Barton (2004) 156 S.W.3d 604, 607 citing Tex.R. Civ. P. 329b(f); Johnson, 132 S.W.3d at 178.)
A collateral attack is any proceeding to avoid the effect of a judgment that does not meet all the requirements of a valid direct attack, i.e., a motion for new trial or a bill of review. (Toles v. Toles (2003) 113 S.W.3d 899, 914; Zarate v. Sun Operating Ltd., Inc. (2001) 40 S.W.3d 617, 620; Glunz v. Hernandez (1995) 908 S.W.2d 253, 255 n. 3.) For a collateral attack, there is neither a set procedure nor a statute of limitations. (Zarate, 40 S.W.3d at 620-21; Glunz, 908 S.W.2d at 255.) Collateral attacks may only be used to set aside a judgment that is void or involves fundamental error. (Zarate, 40 S.W.3d at 621; Glunz, 908 S.W.2d at 255.)
A judgment is void if it is shown that the court lacked jurisdiction:
(Zarate, 40 S.W.3d at 621; Glunz, 908 S.W.2d at 255 (citing Cook v. Cameron (1987) 733 S.W.2d 137, 140; see also Browning v. Placke (1985) 698 S.W.2d 362, 363.)
When reviewing a collateral attack, [the court] presume[s] the validity of the judgment under attack. (Shackelford v. Barton (2004) 156 S.W.3d 604, 606 citing Johnson v. Ventling (2004) 132 S.W.3d 173, 177.) The recitations of the judgment control the rest of the record, and extrinsic evidence cannot be used to establish a lack of jurisdiction. (Narvaez v. Maldonado (2004) 127 S.W.3d 313, 317.) A collateral attack fails if the judgment contains jurisdictional recitals, even if other parts of the record show a lack of jurisdiction. (Johnson, 132 S.W.3d at 178; Toles, 113 S.W.3d at 914.)
If a party fails to establish that court lacked jurisdictional power to render judgment, a bill of review is exclusive remedy to set aside judgment. (Middleton v. Murff (1985) 689 S.W.2d 212 stating “[for a] consent judgment [that is] not void, ... the requirements of a bill of review must be met to set it aside.”.)
The probate court is vested with substantial potential jurisdiction regarding “matters incident to an estate,” (Cunningham v. Parkdale Bank (1983) 660 S.W.2d 810, 812-13 citing Tex.Prob Code Ann. § 5(d) (1980).) This jurisdiction is activated and becomes actual jurisdiction over a party only after the filing of a petition the subject matter of which is within the jurisdiction of the court. (Hughes v. Atlantic Refining Co. (1968) 424 S.W.2d 622, 625.) Further, a judgment must be supported by the pleadings and, if not so supported, it is erroneous. (City of Fort Worth v. Gause (1937) 129 Tex. 25, 101 S.W.2d 221, 223.) Thus, a party may not be granted relief in the absence of pleadings to support that relief. (Stoner v. Thompson (1979) 578 S.W.2d 679, 682; Tex.R.Civ.P. 301.)
It is well established that “not only can a void judgment be attacked by a bill of review after a trial court's plenary power has expired, but a void judgment can be collaterally attacked.” (See Glunz v. Hernandez (1995) 908 S.W.2d 253, 255; Tidwell v. Tidwell (1980) 604 S.W.2d 540, 542 [finding that a void judgment may be collaterally attacked by a suit to set aside the judgment after it has become final if such void judgment becomes material].)
It is well established that “[a] collateral attack is any proceeding to avoid the effect of a judgment which does not meet all the requirements of a valid direct attack.” (Zarate v. Sun Operating (2001) 40 S.W.3d 617, 620-21 citing Glunz, 908 S.W.2d at 255.) There is neither a set procedure for a collateral attack nor a statute of limitations. See Glunz, 908 S.W.2d at 255; Davis v. Boone, 786 S.W.2d 85, 87 (Tex.App.-San Antonio 1990, no writ).
Courts have uniformly held that “[c]ollateral attacks may be only used to set aside a judgment which is void, or which involved fundamental error.” (See Glunz, 908 S.W.2d at 255.) Further, “[f]undamental error for this purpose means cases where the record shows the court lacked jurisdiction or that the public interest is directly and adversely affected as that interest is declared in the statutes or the Constitution of Texas.” (Id.) “The cases distinguish between judgments which are void, and therefore may be set aside by a collateral attack, and those which are voidable and must be attacked by a valid direct attack.” (Id.)
