A section 2-615 motion to dismiss [for failure to state a claim] challenges the legal sufficiency of a complaint based on defects apparent on its face. (Marshall v. Burger King Corp. (2006) 222 Ill. 2d 422, 429-30 citing 735 ILCS 5/2-615 [West 2002]; City of Chicago v. Beretta U.S.A. Corp. (2004) 213 Ill. 2d 351, 364.)
“A motion to dismiss for failure to state a claim should be granted only if the pleadings fail to set forth facts which will entitle the plaintiff to recovery.” (Jorgensen v. Whiteside (1992) 233 Ill. App. 3d 783, 786 citing Burdinie v. Village of Glendale Heights (1990) 139 Ill.2d 501, 504.)
“[A] cause of action should not be dismissed pursuant to section 2-615 unless it is clearly apparent that no set of facts can be proved that would entitle the plaintiff to recovery.” (Marshall v. Burger King Corp. (2006) 222 Ill. 2d 422, 429-30 citing Canel v. Topinka (2004) 212 Ill. 2d 311, 318.)
“In reviewing whether a motion to dismiss is proper, ‘all well-pleaded facts will be regarded as true and all reasonable inferences should be construed in plaintiff's favor.’” (Jorgensen v. Whiteside (1992) 233 Ill. App. 3d 783, 786 citing Swett v. Village of Algonquin (1988) 169 Ill. App.3d 78, 82.)
An appellate court “review[s] de novo an order granting or denying a section 2-615 motion.” (Marshall v. Burger King Corp. (2006) 222 Ill. 2d 422, 429-30 citing Wakulich v. Mraz (2003) 203 Ill. 2d 223, 228.) “In reviewing the sufficiency of a complaint, we accept as true all well-pleaded facts and all reasonable inferences that may be drawn from those facts.” (Ferguson v. City of Chicago (2004) 213 Ill. 2d 94, 96-97.)
Reviewing courts “also construe the allegations in the complaint in the light most favorable to the plaintiff.” (Marshall v. Burger King Corp. (2006) 222 Ill. 2d 422, 429-30 citing King v. First Capital Financial Services Corp. (2005) 215 Ill. 2d 1, 11-12.)
The Supreme Court of Illinois has “repeatedly stated, [...] that Illinois is a fact-pleading jurisdiction.” Marshall, supra 222 Ill. 2d at 430 citing , e.g., Weiss v. Waterhouse Securities, Inc. (2004) 208 Ill. 2d 439, 451.) “While the plaintiff is not required to set forth evidence in the complaint, the plaintiff must allege facts sufficient to bring a claim within a legally recognized cause of action, not simply conclusions.” (Marshall, supra, 222 Ill. 2d at 429-30 citing Chandler v. Illinois Central R.R. Co. (2003) 207 Ill. 2d 331, 348; Vernon v. Schuster (1997) 179 Ill. 2d 338, 344; Anderson v. Vanden Dorpel (1996) 172 Ill. 2d 399, 408.)
“All that is required to survive a motion to dismiss for failure to state a claim is that the plaintiff allege facts that, taken as true, are sufficient to bring a claim within a recognized cause of action.” (Vill. of W. Dundee v. First United Methodist Church of W. Dundee (2017) 74 N.E.3d 144, 150 citing Kanerva v. Weems , 2014 IL 115811, ¶ 33, 383 Ill.Dec. 107, 13 N.E.3d 1228.) “In other words, a complaint should not be dismissed on section 2-615 grounds unless no set of facts would warrant relief.” (Vill. of W. Dundee v. First United Methodist Church of W. Dundee (2017) 74 N.E.3d 144, 150 citing Borcia v. Hatyina , 2015 IL App (2d) 140559, ¶ 20, 391 Ill.Dec. 622, 31 N.E.3d 298.)
