“This Court's authority to stay an order derives from 30 V.S.A. sub. sec. 14, which authorizes the Court to suspend the execution of an order as justice and equity require.” (See In re Tariff Filing of N.E. Tel. Tel. Co. (1984) 145 Vt. 309, 311.)
“A stay in this context is a suspension of proceedings until a specified event occurs in another case. It is in the nature of a continuance." (See Vt. Fed'n of Sportsmen's Clubs v. Birmingham (2020) 229 A.3d 704, 706.)
“To prevail on a motion for stay, the moving party must demonstrate:
(See In re Insurance Servs. Office, Inc. (1987)148 Vt. 634, 635, 537 A.2d 134, 134; Gilbert v. Gilbert (1995) 163 Vt. 549, 560.)
“The trial court has broad discretionary authority to control its case docket and judicial resources.” (See Cegalis v. Knutsen, No. 22-AP-280, at *4 (Vt. May 5, 2023).)
“The trial court has discretion in granting or denying a motion for stay pending appeal.” (See Gilbert v. Gilbert (1995) 163 Vt. 549, 560.)
“Discretionary rulings by the trial court will not be disturbed unless an abuse of discretion is clearly shown.” (See id.)
“Thus, we will not disturb the court's determination unless its exercise of discretion was on grounds or for reasons clearly untenable, or the exercise of discretion was to a clearly unreasonable extent.” (See Meyer v. Meyer (2001) 173 Vt. 195, 197.)
It is well settled that “in any action in which an automatic stay prior to appeal is in effect pursuant to paragraph (1) of subdivision (a) of this rule, the taking of an appeal from a judgment shall operate as a stay of execution upon the judgment during the pendency of the appeal, and no supersedeas bond or other security shall be required as a condition of such stay.” (See In re L.A (2008) 183 Vt. 168, 172 n.1.)
It is also well settled that “where there is a possibility that a stay will damage someone else, the party seeking the stay must make out a clear case of hardship or inequity in being required to go forward. The trial court must weigh the parties' competing interests with this standard in mind.” (See Vt. Fed'n of Sportsmen's Clubs v. Birmingham (2020) 229 A.3d 704, 707.)
