“Civil Rule 65 governs trial court procedure for obtaining an injunction.” (See Northwest Gas Ass'n v. Washington Utilities & Transportation Commission (2007) 141 Wn. App. 98, 113.)
“The process generally progresses from temporary restraining order, to preliminary injunction, to permanent injunction.” (See id.)
“A preliminary injunction serves the same general purpose as a temporary restraining order — to preserve the status quo until the trial court can conduct a full hearing on the merits of the complaint.” (See McLean v. Smith (1971) 4 Wn. App. 394, 482 P.2d 798 (1971); Northwest Gas Ass'n v. Washington Utilities & Transportation Commission (2007) 141 Wn. App. 98, 115-16.)
“The law is well settled that to obtain injunctive relief, a plaintiff must establish:
(See Tyler Pipe Indus., Inc. v. Dep't of Revenue (1982) 96 Wn.2d 785, 792, 638 P.2d 1213; Northwest Gas Ass'n v. Washington Utilities & Transportation Commission (2007) 141 Wn. App. 98, 115.)
“The plaintiff must satisfy these three basic requirements regardless of whether the injunction he seeks is temporary or permanent.” (See Fed. Way Family Physicians, Inc. v. Tacoma Stands Up for Life (1986) 106 Wn.2d 261, 265, 721 P.2d 946; Northwest Gas Ass'n v. Washington Utilities & Transportation Commission (2007) 141 Wn. App. 98, 115.)
“At a preliminary injunction hearing, the plaintiff need not prove and the trial court does not reach or resolve the merits of the issues underlying these above three requirements for injunctive relief.” (See Northwest Gas Ass'n v. Washington Utilities & Transportation Commission (2007) 141 Wn. App. 98, 116.)
“Rather, the trial court considers only the likelihood that the plaintiff will ultimately prevail at a trial on the merits by establishing that he has a clear legal or equitable right, that he reasonably fears will be invaded by the requested disclosure, resulting in substantial harm.” (See id.)
“Whether to grant a temporary injunction lies within the sound discretion of the court, to be exercised according to the circumstances of each case.” (See Isthmian S.S. Co. v. National Marine Engineers' Beneficial Ass'n (1952) 41 Wn.2d 106, 247 P.2d 549; Alderwood Assocs. v. Envtl. Council (1981) 96 Wn. 2d 230, 233.)
“In exercising that discretion and in granting a temporary injunction, the court must issue findings of fact and conclusions of law and set forth in the order the reasons for its issuance.” (See Alderwood Assocs. v. Envtl. Council (1981) 96 Wn. 2d 230, 233-34.)
“[B]efore or after the commencement of the hearing of an application for a preliminary injunction, the court may order the trial of the action on the merits to be advanced and consolidated with the preliminary injunction application hearing.” (See Northwest Gas Ass'n v. Washington Utilities & Transportation Commission (2007)141 Wn. App. 98, 113.)
“But [i]f [a] court does not expressly state that it is consolidating the injunction hearing and a trial on the merits, it may not render a final determination on the merits.” (See id.)
“The purpose of this rule, as with its federal counterpart, is to give the parties notice and time to prepare so that they will have a full opportunity to present their cases at the permanent injunction hearing.” (See Univ. of Tex. v. Camenisch (1981) 451 U.S. 390, 395, 101 S. Ct. 1830, 68 L. Ed. 2d 175; Northwest Gas Ass'n v. Washington Utilities & Transportation Commission (2007) 141 Wn. App. 98, 113-14.)
It is well settled that “a temporary restraining order is an order entered without notice, or after informal notice. It operates for a period not to exceed 14 days unless extended for good cause.” (See CR 65(b); Fisher v. Parkview Properties (1993) 71 Wn. App. 468, 474.)
It is also well settled that “a temporary restraining order is proper only when there is a clear showing, based on specific facts, that the applicant will suffer irreparable injury, loss, or damage before an adversary hearing can be convened in open court. A temporary restraining order or injunction is issued wrongfully when it would not have been ordered had the court been presented all of the facts.” (See id.)
