Malicious prosecution is the pursuit of a criminal prosecution or civil suit that is brought maliciously and without probable cause. (Morris v. Hargrove, 351 S.W.2d 666, 667.) The grounds for bringing a such an action is for the humiliation and scandal that would be suffered by the person who would be wrongfully prosecuted. (Daughtry v. Blanket State Bank, 60 S.W.2d 272, 273.) One who institutes such a proceeding is liable to the person against whom the proceedings were brought for malicious prosecution. (Smart v. Carlton, 557 S.W.2d 553, 554.)
The elements of an action for malicious prosecution are:
(Richey v. Brookshire, 952 SW2d 515.)
The law generally presumes that a defendant acted reasonably and in good faith when instituting an action. (Kroger Tex., L.P. v. Suberu, 216 S.W.3d 788, 794.) Therefore, it is the plaintiff’s burden to prove no probably cause existed by a preponderance of the evidence. (Richey v. Brookshire Grocery Co., 952 S.W.2d 515, 517.) If the plaintiff does not meet this burden, the presumption of probable cause remains unrebutted and the defendant is entitled to judgment as a matter of law. (Kroger Tex., L.P. v. Suberu, 216 S.W.3d 788, 795.) However, if the plaintiff meets their burden, the burden shifts to the defendant to offer evidence that demonstrates probable cause. ([Akin v. Dahl, 661 S.W.2d 917, 920.)
Malice may be established by circumstantial or direct evidence. (Marin Real Estate Partners., L.P. v. Vogt, 373 S.W.3d 57, 91.) Personal ill will or spite is relevant to the issue of malice but is not essential. (Reed v. Lindley, 240 S.W. 348, 35.) Malice may be inferred from a wrongful act done in reckless disregard of the rights of another and in conscious indifference as to whether the other party is injured. (Id.)
A plaintiff is entitled to recover all elements of the injury caused by the malicious prosecution. Damages may include but are not limited to (1) loss of time; (2) injury to feelings, reputation, character, and health; (3) mental suffering; (4) actual loss and injury to property, interest, and credit; and (5) decreased earning capacity. (Davis v. Teague, 256 S.W. 957, 961–962; Eans v. Grocers Supply Co., 580 S.W.2d 17, 22–23.) Additionally, plaintiffs may recover expenses incurred in order to obtain the plaintiff’s release from arrest and expenses related to the defense of criminal prosecution. (Green v. Meadows, 527 S.W.2d 496, 498.)
A malicious prosecution action must be brought within 1 year after it accrues. (Torres v. GSC Enterprises, Inc., 242 SW3d 553, 242.) The cause of action accrues when the prosecution is concluded. (Id.)
