“A judgment creditor is entitled to aid from a court of appropriate jurisdiction ... in order to reach property” to satisfy a judgment “if the judgment debtor owns property” that “cannot readily be attached or levied on by ordinary legal process” and “is not exempt from attachment, execution, or seizure for the satisfaction of liabilities.” (Pajooh v. Royal W. Invs. LLC (2017) 518 S.W.3d 557, 566 citing Tex. Civ. Prac. & Rem. Code § 31.002(a); see also, Tanner v. McCarthy (2008) 274 S.W.3d 311, 322.)
A turnover order is a “procedural device by which judgment creditors may reach assets of a debtor that are otherwise difficult to attach or levy on by ordinary legal process.” (Beaumont Bank N.A. v. Buller (1991) 806 S.W.2d 223, 224; see also Tex. Civ. Prac. Rem. Code Ann. § 31.002(a).)
The purpose of the turnover proceeding is merely to ascertain whether or not an asset is in the possession of the judgment debtor or subject to the debtor's control. If the asset sought is a cash sum, then the turnover proceeding can only order the debtor to turn over as much of the cash amount as is in the possession or control of the debtor. (Beaumont Bank, supra, 806 S.W.2d at 227 citing Tex. Civ. Prac. Rem. Code sec. 31.002(b)(2) [Vernon 1986].)
To accomplish turnover, the court may:

A turnover order may be enforced by contempt proceedings. (Tex. Civ. Prac. Rem. Code Ann. § 31.002(c).)
To initiate an order to turnover property a judgment creditor must file an application for turnover. The primary purpose of the turnover proceeding is to ascertain whether an asset is in the judgment debtor's possession or subject to his control. (See Beaumont Bank, supra, 806 S.W.2d at 227.)
The judgment creditor must include the following in the pleading:

Section 31.002 does not specify, or restrict, the manner in which evidence may be received in order for a trial court to determine whether the conditions of section 31.002(a) exist, nor does it require that such evidence be in any particular form, that it be at any particular level of specificity, or that it reach any particular quantum before the court may grant aid under section 31.002. (Tanner v. McCarthy (2008) 274 S.W.3d 311, 322.) However, a trial court must nonetheless determine that the request for aid pending before the court falls within the scope of section 31.002 before it enters an order granting relief under that section. (Id.) In making this determination, the trial court must have some evidence before it that establishes that the necessary conditions for the application of 31.002 exist. (Id.)
A turnover order “requires the debtor to bring to the court all documents or property used to satisfy a judgment. The actual effect of the bill is to require the burden of production of property which is subject to execution to be placed with the debtor instead of a creditor attempting to satisfy his judgment.” (Beaumont Bank, supra, 806 S.W.2d at 226.) It is this aspect of a turnover order (i.e., that it acts “in the nature of a mandatory injunction”) which makes it appealable. (Kennedy v. Hudnall (2008) 249 S.W.3d 520, 524.)
An order requiring the turnover of nonexempt property need not identify the “specific property subject to turnover.” (Pajooh, id., supra, quoting § 31.002(h).) Nevertheless, the trial court must receive evidence to enable it to determine that the applicant has shown its entitlement to a turnover order under Section 31.002. (See Tanner v. McCarthy (2008) 274 S.W.3d 311, 322.) A motion supported only by argument of counsel will be insufficient. (See id. at 322–23.)
A turnover and receivership order under Chapter 31 can be used to reach both “present or future rights to property” that is both nonexempt and “cannot be readily attached or levied on by ordinary legal process.” (Pajooh v. Royal W. Invs. LLC (2017) 518 S.W.3d 557, 566-67 citing Tex. Civ. Prac. & Rem. Code § 31.002(a).) The court is not required to identify the specific nonexempt property subject to turnover in the order. (Id. § 31.002(h).) Thus, a Chapter 31 turnover and receivership order may be used to monitor partnership distributions and effectuate a charging order. (See Stanley v. Reef Securities, Inc. (2010) 314 S.W.3d 659 at 664–65; see also Goodman v. Compass Bank (2016) No. 05-15-00812-CV, 2016 WL 4142243, at *11 (mem. op.) [affirming order requiring turnover of property that included present and future rights to proceeds from limited partnerships, LLC, and other corporate entities.])
It is well established that “Texas courts do not apply the turnover statute to non-judgment debtors.” (Beaumont Bank N.A. v. Buller (1991) 806 S.W.2d 223, 227 citing, e.g., Cravens, Dargan Co. v. Travers Co. (1989) 770 S.W.2d 573, 576 [no turnover action against State Board of Insurance for judgment debtor's licensing deposit]; Detox Industries, Inc. v. Gullett (1989) 770 S.W.2d 954, 956[no turnover action against non-debtor corporation to cancel stock in judgment debtor's name and reissue in creditor's name]; United Bank Metro v. Plains Overseas Group (1983) 670 S.W.2d 281, 284 [no turnover action against corporate alter ego of judgment debtor.])
It is well settled that the court of appeals reviews the trial court's order or judgment in a turnover proceeding for abuse of discretion. (Van Dyke v. Littlemill Ltd. (2019) 579 S.W.3d 639, 645.) Further, it is well established that “[a] trial court abuses its discretion when it acts in an unreasonable or arbitrary manner, without reference to any guiding rules and principles.” (Id.) Additionally, “[a] trial court has no discretion in determining what the law is or applying the law to the facts.” (See Huie v. DeShazo (1996) 922 S.W.2d 920, 927; Marrs v. Marrs (2011) 401 S.W.3d 122, 124.)
