“Under Rule 59(e), the court may reconsider issues previously before it, and generally may examine the correctness of the judgment itself." (See In re Robinson/Keir P'ship (1990) 154 Vt. 50, 54, 573 A.2d 1188, 1190; In re B.K. (2017) 179 A.3d 758, 762.)
“[M]otions to alter or amend judgment allow the trial court to revise its initial judgment if necessary to relieve a party against the unjust operation of a record resulting from the mistake or inadvertence of the court and not the fault or neglect of a party." (See Sutton v. Purzycki (2022) Vt. 56, 29 Northern Security Insurance v. Mitec Electronics, Ltd. (2008) 184 Vt. 303.)
“A Rule 59(e) motion must clearly establish either a manifest error of law or fact or must present newly discovered evidence." (See id.)
Rule 59 of the Vermont Rules of Civil Procedure governs amendments of judgments.
“A motion to alter or amend the judgment shall be filed not later than 28 days after entry of the judgment.” (See Vt. R. Civ. P. 59(e).)
“A party adversely affected by the Court's action may file a motion to reconsider, vacate, or modify that action.” (See Vt. R. App. P. 27(b)(3).)
“We review the trial court's decision on a Rule 59(e) motion to amend judgment for an abuse of discretion.” (See Sutton v. Purzycki (2022) Vt. 56, 29; N. Sec. Ins. Co. v. Mitec Elec., Ltd. (2008) VT 96, ¶ 34, 184 Vt. 303, 965 A.2d 447.)

“Abuse of discretion occurs when that discretion is exercised on grounds or for reasons clearly untenable, or to an extent clearly unreasonable." (See In re Gaines Farm Cmty. Solar, LLC, SUPREME COURT No. 2017-263, at *2 (Vt. Dec. 1, 2017) In re Halnon (2002) 174 Vt. 514, 517.)
It is well settled that “reconsideration motions may not be used to raise new claims that could have been raised prior to the entry of judgment.” (See Stevens Law Office v. Heyer, SUPREME COURT No. 2017-400, at *5 (Vt. Apr. 6, 2018).)
It is also well settled that “a court can dismiss motion to reconsider without addressing merits when it raises a wholly new legal theory.” (See Campbell v. Stafford (2011) Vt. 11; State of Vt. Agency of Nat. Res. v. Parkway Cleaners (2019) 210 A.3d 445, 460.)
