“Upon timely application anyone may be permitted to intervene in an action . . . when an applicant’s claim or defense and the main action have a question of law or fact in common.” (See Cherokee Metro. Dist. v. Booker (2013) 304 P.3d 1167.)
“Persons desiring intervention shall serve a motion to intervene upon the parties, stating the grounds therefor.” (See C.R.C.P. 24(c); Weston v. TT, Court of Appeals No. 09CA2786, at *5 (Colo. App. May 26, 2011).)
“Upon timely application anyone shall be permitted to intervene in an action: (1) When a statute confers an unconditional right to intervene; or (2) when the applicant claims an interest relating to the property or transaction which is the subject of the action and he is so situated that the disposition of the action may as a practical matter impair or impede his ability to protect that interest, unless the applicant's interest is adequately represented by existing parties." (See O'Hara Group Denver v. Marcor Housing (1979) 197 Colo. 530, 538.)
“In exercising its discretion the court shall consider whether the intervention will unduly delay or prejudice the adjudication of the rights of the original parties.” (See Cherokee Metro. Dist. v. Booker (2013) 304 P.3d 1167.)
“In the past, we have held that [i]f permission [to intervene] was permissive only, denial thereof is not appealable unless the court abuses its discretion.” (See id; Grijalva v. Elkins (1955) 132 Colo. 315, 318, 287 P.2d 970, 972.)
“When a trial court allows intervention, its ruling should not be disturbed absent a showing of abuse of discretion.” (See Rutenbeck v. Grossenbach (1993) 867 P.2d 36, 38.)
“Thus, in order to determine whether denial of permissive intervention is a final appealable order, we must first determine whether the trial court abused its discretion.” (See Cherokee Metro. Dist. v. Booker (2013) 304 P.3d 1167.)
“It can seldom, if ever, be shown that the trial court abused its discretion in denying the permissive right to intervene.” (See id; Grijalva (1955) 132 Colo. 315, 319, 287 P.2d 970, 972.)
It is well settled that “intervention may be sought when a statute provides an unconditional right to intervene.” (See In re Marriage of Shapard (2004)129 P.3d 1007, 1009.)
It is also well settled that “F.R.C.P. 24(a)(2) permits a party to intervene only if they can demonstrate that they claim an interest relating to the property or transaction that is the subject of the action, and is so situated that disposing of the action may as a practical matter impair or impede the movant's ability to protect its interest." (See C.W.B. v. A.S. (2018) CO 8, 30.)
