“While a stay and a preliminary injunction are not identical, they result in a similar procedural outcome: the implementation of a proceeding or rule is halted to preserve the status quo.” (See Planned Parenthood Great Nw. v. State, No. 49615, at *6 (Idaho Aug. 12, 2022).)
“A preliminary injunction is the ‘strong arm of equity’ which, as an extraordinary remedy, must be exercised with great restraint.” (See Bonaparte v. Camden & A.R. Co. (1830) 3 F. Cas. 821, 827; see also Munaf v. Geren (2008) 553 U.S. 674, 689 (2008) [a preliminary injunction is [a] [. . .] drastic remedy].)
“Before Idaho became a territory in 1863, the common law supported the view that (1) a preliminary injunction would issue only if the right to the ultimate relief requested was clear and (2) such preliminary relief could not be issued in doubtful cases, or new ones, not coming within well established principles." (See Planned Parenthood Great Nw. v. State, No. 49615, at *6 (Idaho Aug. 12, 2022).)
“The purpose of a preliminary injunction is to maintain the status quo and prevent irreparable injury during the pendency of the action.” (See Farm Service, Inc. v. United States Steel Corp. (1966) 90 Idaho 570, 575.)
“A preliminary injunction is a temporary injunction effective for the pendency of the litigation before the merits of the case are decided.” (See I.R.C.P. 65(e); Gem State Roofing, Inc. v. United Components, Inc. (2021) 488 P.3d 488, 502.)
“Preliminary injunctions are designed to protect clearly established rights from imminent or continuous violation during litigation.” (See id; Gordon v. U.S. Bank Nat'l Ass'n (2019) 166 Idaho 105, 455 P.3d 374, 384.)
"A district court should grant a preliminary injunction only in extreme cases where the right is very clear and it appears that irreparable injury will flow from its refusal.” (See id; Brady v. City of Homedale (1997) 130 Idaho 569, 572, 944 P.2d 704, 707.)
“A permanent injunction, on the other hand, is entered at the resolution of the case, and requires a showing of threatened or actual irreparable injury; in addition, in order to deny a permanent injunction the trial court must be persuaded that there is no reasonable expectation that the wrong will be repeated." (See Gem State Roofing, Inc. v. United Components, Inc. (2021) 488 P.3d 488, 502.)
“A preliminary injunction may be granted in the following cases:
(See Planned Parenthood Great Nw. v. State, No. 49615, at *6 (Idaho Aug. 12, 2022).).)
“A party seeking a preliminary injunction bears the burden of proving the right thereto . . ." (See Gordon v. U.S. Bank , No. 45202, at *10 (Idaho Aug. 28, 2019); Harris v. Cassia Cty. (1984) 106 Idaho 513, 518, 681 P.2d 988, 993; Lawrence Warehouse Co. v. Rudio Lumber Co. (1965) 89 Idaho 389, 405 P.2d 634.)
"Whether to grant or deny a preliminary injunction is a matter for the discretion of the trial court." (See Brady v. City of Homedale (1997) 130 Idaho 569, 572, 944 P.2d 704, 707.)

“This Court reviews a discretionary decision for [w]hether the trial court:
(See Munden v. Bannock Cnty. (2022) 504 P.3d 354, 363; Lunneborg v. My Fun Life (2018) 163 Idaho 856, 863, 421 P.3d 187, 194; Gem State Roofing, Inc. v. United Components, Inc. (2021) 168 Idaho 820, 488 P.3d 488, 496.)
It is well settled that “in the federal system, a preliminary injunction will only issue when the requesting party can show, among other factors, that he is likely to succeed on the merits and that he is likely to suffer irreparable harm in the absence of preliminary relief[.]" (See Winter v. Natural Resources Defense Council, Inc (2008), 555 U.S. 7, 20; see also Alliance for the Wild Rockies v. Cottrell (2011) 632 F.3d 1127, 1131-32; Planned Parenthood Great Nw. v. State, No. 49615, at *8 (Idaho Aug. 12, 2022)
It is also well settled that “Rule 65(e) enumerates the grounds upon which a district court may grant a preliminary injunction. I.R.C.P. 65(e)(1) authorizes a district court to grant a preliminary injunction when it appears by the complaint that the plaintiff is entitled to the relief demanded, and that relief, or any part of it, consists of restraining the commission or continuance of the acts complained of, either for a limited period or perpetually[.]" (See I.R.C.P. 65(e)(1); Gordon v. U.S. Bank Nat'l Ass'n (2019) 166 Idaho 105, 115.)
